Terms of service

1. Agreement

These Terms of Service are an agreement between you and Foster Media Group, LLC ("Foster Media Group," "we," "us") covering your use of Top 10 Best Smoke Shops, available at 10bestsmokeshops.com and top10smokeshops.com (the "Site").

By using the Site you accept these Terms. If you do not accept them, do not use the Site.

2. Who may use the Site

You must be at least 18 years old (or the legal age to purchase tobacco and smoking products in your state, if higher) to use the Site.

You confirm that you are not prohibited by law from purchasing or using smoking products and that you will not use the Site for any unlawful purpose.

3. What the Site is

The Site is a directory. It lists smoke shops and vape shops in US towns and ranks them from first to tenth using publicly available rating and review data.

We are not a shop, a distributor, or a marketplace. We do not sell, ship, or deliver any product, and we are not a party to any transaction between you and a listed shop.

4. Listings and accuracy

Listings — names, addresses, ratings, review counts, hours, phone numbers and websites — are compiled from public review sources and may be updated, corrected, or removed at any time.

Ratings and reviews belong to the third-party platforms that published them. A ranking is our editorial ordering of that public data, not an endorsement, certification, or guarantee of quality.

Shop details can change without notice. Confirm hours, prices, stock, and legality of any purchase directly with the shop before you visit.

5. Shop claims and owner accounts

A shop owner may claim a listing and create an account. To claim a listing you must be the owner or an authorized representative of that shop.

You are responsible for the accuracy of anything you publish through an owner account, including phone number, website, hours, and description.

We may remove or suspend a claim that appears fraudulent, that we cannot verify, or that the shop disputes.

6. Featured listing subscription

A Featured Listing is a paid subscription that places a claimed shop above the other listings on its town page. The price is $29 per month per shop.

The first month is free. Your payment method is required at signup, and the paid period begins after the free month ends.

The subscription renews monthly until you cancel. Cancel anytime from your owner dashboard; cancellation stops all future charges, and access continues until the period you already paid for ends.

We may change the price with notice before the change takes effect. Continued use after a price change means you accept the new price.

7. Refunds

Refunds are handled under our Refund Policy, which is part of these Terms: see /refund-policy.

8. Your conduct

You agree not to: scrape or bulk-download listings; submit false shop information; claim a shop you do not own; interfere with the Site or its payments; use the Site to sell products to anyone under legal age; or republish our rankings as your own directory without permission.

9. Intellectual property

The Site's name, design, rankings presentation, and original text belong to Foster Media Group, LLC. Shop names, logos, photos, and reviews remain the property of their owners.

You may link to any page on the Site. You may not copy the directory in bulk or mirror it.

10. Third-party links and services

Pages link out to maps, shop websites, and review platforms. We do not control those destinations and are not responsible for their content, pricing, or practices.

11. Disclaimers

The Site is provided "as is" with no warranties of any kind, express or implied, including accuracy, completeness, availability, and fitness for a purpose.

We do not warrant that any listed shop is open, correctly described, or suitable for you.

12. Limitation of liability

To the maximum extent allowed by law, Foster Media Group, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for any damages arising from your use of the Site, a listing's inaccuracy, or a transaction with a listed shop.

If liability cannot be excluded, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or $29 if you have not paid us.

13. Indemnity

If you claim a listing or publish shop details, you will defend and hold Foster Media Group, LLC harmless from claims arising from the information you supplied.

14. Changes to these Terms

We may update these Terms and will change the date below. Material changes to subscription terms will be emailed to account holders before they take effect.

15. Governing law

These Terms are governed by applicable United States federal law and the law of the state in which Foster Media Group, LLC maintains its principal place of business, without regard to conflict-of-law rules.
